Recently, I went on a tandem skydive over Australia’s Sunshine Coast and uploaded an M4 DVD rip onto Youtube. But upon editing the tags I was informed:
Your video, Ramblers Tandem Skydive Sunshine Coast Australia 2009 , may include content that is owned or licensed by these content owners: * Content owner: WMG Type: Audio content * Content owner: Sony Music Entertainment Type: Audio content
Family members said they couldn’t hear anything on the video. Neither could I, although everything did seem OK initially.
I attempted a crude hack to solve the problem. I deleted the video from the tube and uploaded it again with a different filename. The result was the same. Silence.
I did a bit of research and found out I needed to cite Section 107 of the Copyright Act 1976.
“This video uses copyrighted material in a manner that does not require approval of the copyright holder. It is a fair use under copyright law. Copyright Disclaimer Under Section 107 of the Copyright Act 1976, allowance is made for “fair use” for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is a use permitted by copyright statute that might otherwise be infringing. Non-profit, educational or personal use tips the balance in favor of fair use.”
I went to bed and in the morning the video featured the original audio track.
